TERMS & CONDITIONS AND WARRANTY WITH COPYRIGHT ASSIGNED TO CLIENT

  1. We authorise the Studio to arrange the photography of our Event, in accordance with the details on this booking form.
  2. We have received, read and understand the Studio’s price and contract, which has been confirmed for our Event, on payment of the deposit/booking fee. We agree that payment of the initial deposit/booking fee confirms the booking with the Studio as per the details shown in this order.
  3. We agree to pay the full balance as per schedule. Failure to do so gives the Studio the right to refuse to carry out the full photographic services including both photographic & film items. Furthermore, the initial deposit/booking fee will be forfeited. This does not waive our obligation to pay the full balance as per schedule under the terms of this agreement.
  4. The booking of and any additional costs incurred for booking venues, photography locations etc are our responsibility and may be deducted from the photographic coverage unless paid for separately. We also indemnify any claims made against The Studio by third parties and also take it upon ourselves any obligations requested by third parties in relation to our photographic coverage. We agree to protect, defend, indemnify and hold harmless the Studio from and against all claims, losses, liabilities settlements, expenses and damages including legal fees and costs the Studio may suffer or to which the Studio may be subjected for any reason arising out of or related to any act, omission, or occurrence in connection with the creation, production, or use of any image or the performance of any service relating to this agreement or its subject matter. This provision shall apply to claims of every sort and nature, whether based or otherwise. We assume all risks and their obligations under this provision shall survive the performance, termination, or cancellation of this agreement.
  5. We appreciate that on the day of the Event the photographer(s) and assistant(s) will have been working without a break. We understand that if the photographer(s) is required to remain after the guests are seated a full three course meal, as provided to guests, must be provided to the photographer(s) and assistant(s). In cases where other catering arrangements have been made for guests then those will apply, such as buffet or savouries etc.
  6. We are satisfied that the details are correct and will confirm the details prior to the Event. We agree to advise the hairdressers and make-up artists, the hire cars, caterers, DJs and other related vendors of all the relevant times, details and locations as detailed here and to coordinate their services.
  7. The details & times listed form part of this agreement and we agree to make every effort to cooperate and maintain an appropriate conduct in order for the Studio to fulfill its contracted photographic duty. We acknowledge the Studio cannot accept responsibility for the ‘extent’ of the photographic coverage if these details are incorrect or if we choose not to follow the agreed schedule or inappropriate conduct on our part. Crews have the right to cease and leave an event if they feel that they are put in a position of risk to themselves or their equipment and no monetary or legal claims shall be made against the Studio. Monies will not be refunded under these circumstances.
  8. In the spirit of a true live news-gathering production, the Studio cannot guarantee an image or audio representation of every person or event occurring at the function\service, even though care is taken & no legal or financial claims shall be made against the Studio. The client understands that any film and still coverage is a ‘live’ & unrehearsed production, with a budget dictated by the client. This has direct impact on the Studio’s capabilities and outcome of the film & stills. Therefore, the client does not expect their coverage to be the same standard as that of a major movie production house, with large budgets & opportunities to rehearse and retake scenes and adjust sound quality and levels.
  9. Crews MUST always be given at least two minute’s notice before speeches or any other event commences.
  10. The studio reserves the right to film and edit the event at its discretion. If there are instructions given to crews on the function day in relation to recording by members of the bridal party, family members, or participants of the function, the crews will ultimately follow instruction given by the signatories on this agreement. After this time, specific alterations\deletions of video content requested by the client must be given in writing directly to the studio (and not just told to the camera crews on the function day) within three days after the function date. Otherwise, any extra editing, which is at the studio’s discretion, will be charged.
  11. We retain the Studio as the sole photographer. To avoid disruption to the photographic coverage and to allow the Studio to fulfill its contracted duty, other photography by family and friends will be at the discretion of the Studio’s photographer.
  12. We accept the responsibility to contact the Studio, at least two weeks prior to Event, to confirm details are correct and there are no alterations.
  13. We agree to immediately advise the Studio in writing of any alterations in the details listed here including postponement or cancellation of the Event.
  14. In the event of cancellation we agree that the deposit/booking fee will be forfeited unless within 7 days of booking. In the event of cancellation of our photography coverage is made within a 7 day period prior to our Event we agree to pay the full balance as per schedule. 
  15. We agree the Copyright in all images and film is owned by the Client. The Studio must obtain written permission by the Client to use any image/footage of our Event for industry competitions, advertising, publicity, general promotion, exhibitions, art sales and any other purpose.
  16. All reasonable freight and postage, which we request, will be paid by us for items not picked up at our studio located in Israel. While care is taken, the studio is not responsible for safe and prompt delivery of products and other material that is mailed or delivered by other means. Any extra copies ordered after the initial products are paid and picked up, must be prepaid. Any insurance cover or taxes imposed on items delivered to us will be our expense. 
  17. This applies to coverage’s including albums and explains the process we have accepted to obtain our pre-purchased album price reduction: Once our finished images of our event are uploaded to our personal website. Within 2 weeks we are required to make our selection for all albums. Within the following 2 weeks we will receive from the Studio, our album design plan(s) electronically as PDF file(s). Within the following 2 weeks we will notify the Studio of any changes required or just give our final approval. Within the following 2 weeks we pay the subject balance when notified the album is ready for production OR make our final approval for the requested design changes and pay the subject balance when notified the album is ready for production.
  18. The Studio will then endeavour to submit album plans for approval no later than 2 weeks after receipt of our image selection. Should the album plan(s) by the Studio take longer than the 2 weeks; the additional days will be calculated and added to the 8 weeks and extend the “subject balance” by those number of days. Failure to comply with the above schedule on our part may forfeit the reduced pre-purchased album price and the full current album price at the time will applicable and payable by us. We understand we are allowed one set of changes after receiving our initial album plan PDF. Any further changes will attract a re-design fee.
  19. The Studio’s desire is to fully and creatively document your event, with no limitation on the number of images taken nor the number of pages, which may end up in your final album. When we proudly present you with an initial album, it will have been designed to best tell your wedding story in an artistic & creative way. It may include more pages than you have paid for in your selected coverage. Our suggestions can be varied and you, our client, are the final decision maker on which images to keep in your album.
  20. We have up to two weeks following the delivery of our film to request any changes or edits. After this time the finished film is deleted without notice, and no subsequent editing will be available. In the event our coverage balance is not paid within 30 days of our event (unless otherwise agreed by The Studio in writing) all original footage will be deleted and our film coverage will be forfeited.
  21. The Studio has no control over the environment in which the photographs are kept and that colour photographs, in common sensitised material and colour dyes, have limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources. Photographs will retain their colour and brilliance much longer when displayed under better lighting conditions.
  22. Should the nominated photographer not be available for any reason, the Studio will notify you of the change as soon as it is known and provide another photographer. In this instance, the client may terminate this contract and receive a full refund less a $US100 termination fee.
  23. The Studio will provide us with a selection of images taken on the day. Images supplied are solely at the studio’s discretion.
  24. As the photographs made by the Studio are manufactured with the finest materials currently available, the Studio guarantees them. If in your opinion any photograph made by the Studio has lost its original colour, the Studio will replace the photograph for fifty per cent of the current selling price. The original photograph must be returned and the reprinting charge paid in advance. This warranty will be valid for as long as the Studio has its possession the original media in a printable condition.
  25. The Studio shall carry out this assignment with due and professional diligence. Elements beyond the Studio’s control include; problems arising due to unpredictable nature of assignment, faulty material, equipment failure, hard drive and computer failure, loss of files/drives/cards in transit or failure, loss of media, industrial disputes, civil disturbances, traffic congestion, car or traffic accidents, or delays caused by the participants of the function, or delays at the service, or reception, etc or weather conditions which may inhibit or prevent the Studio completing in whole or in part this assignment and other occurrences. In this case, the Studio shall not be liable for its complete performance of the assignment. The Studio is not liable for degradation of video image or sound quality due to disruptions beyond their control. This may be caused by miscellaneous obstructions, or by the minister\celebrant or function manager’s constraints placed on video crews, or from decorations, various architectural, mechanical and lighting features, interference caused by mobile phones, individuals, environmental factors, poor sound due to venues’ sound systems, or lack of one, or from poor microphone technique or sound projection by the participants at the function or service, etc. The Studio will make every reasonable effort to meet our wishes regarding desired images, but shall not be held responsible for failing to photograph particular individuals, combination of particular individuals, groups or particular moments.
  26. It is agreed that all liability of the Studio shall be limited to be a refund at the Studios discretion of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered under the jurisdiction of Israel – Tel Aviv. In no circumstances shall the Studio be liable for any amount that is greater than that has been paid to The Studio.
  27. As laws change and from time to time The Studio may feel it necessary to update its terms and conditions and therefore reserves the right to add or amend these terms any time without notice which we agree to accept.
